| These Terms and Conditions are recommended by The Guild of Photographers ("The Guild") for its members acting for private clients in, for example, photographing weddings, christenings and other events. Both parties to this Contract agree that these Terms and Conditions form part of the Contract Agreement between the first party Shattered Glass Photography, hereafter called "The Photographer" and the second party i.e. the person/persons booking the photographic services, hereafter called "the Client". It is also agreed that no subsequent changes or modifications will be made to the Contract without the agreement in Writing of both parties. | ||||
| INTERPRETATION | ||||
|
"Conditions" |
||||
|
Means the terms and conditions of trading set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in between the Photographer and the Client. |
||||
|
"The Contract" |
||||
|
Means the Contract form for the supply of the Services upon the Conditions that shall override in consistent terms implied by trade custom or practice or previous dealings or any contrary or additional terms contained or referred to in the Client's order form. |
||||
|
"Services" |
||||
|
Means the provision of the Finished Media of the Event by the Photographer including attendance at the event and recording of the Event in accordance with the Conditions. |
||||
|
"in Writing" |
||||
|
Includes telex cable facsimile transmission and comparable means of communication. The headings in the Conditions are for convenience only and shall not affect their interpretation. Where any party is more than one person any obligations of that party shall be joint and several obligations. |
||||
|
“Booking” |
||||
|
All bookings for wedding photography must be made on The Photographers standard booking form and shall be signed by The Client. No terms or conditions relating to the booking that is not included on the standard form shall be binding on The Photographer. |
||||
|
“Payment” |
||||
|
The Client shall pay a deposit of £100.00 inclusive of VAT on booking. The balance of the agreed fee shall be due and payable one calendar month prier to the date of the wedding. Because of the difficulty in obtaining replacement bookings this deposit will not be refunded if the Client cancels or purports to cancel the Contract. Payment in respect of additional prints, albums, frames etc shall be made in full at the time of ordering. |

|
“Cancellation” |
||||
|
In the event of cancellation of the booking by the client, the Photographer reserves the right to charge a cancellation fee in accordance with the following scale: |
||||
|
50% of the agreed fee if cancelled less than 6 months prior to the wedding date. |
||||
|
100% of the agreed fee if cancelled within 12 weeks of the wedding. |
||||
|
“The Photographer” |
||||
|
*Will have reasonable artistic license in regard to scenes, poses, locations, editing and production etc. as applicable. The judgment of the Photographer will be deemed correct. Whilst some guests may wish to make a personal photographic recording of the event The Photographer may insist they stop making such recordings if they become intrusive or distracting or form any nuisance or hindrance to The Photographer. |

|
*Will at all times strive to maintain the highest standard of workmanship and artistic ability and will work within the reasonable terms set by The Client or by any official or person possessing the correct and legal authority to set limitations or restrictions. |
||||
|
*Will not be responsible for non-fulfilment of The Contract if restricted by unreasonable limitations. |
||||
|
*Will carry out the assignment with all proper respect and decorum for the environment and surroundings, causing the minimum of distraction and disturbance necessary to achieve a satisfactory photographic recording. |
||||
|
*Will comply with the standard of dress and conduct appropriate to the occasion in which they are working. |
||||
|
*Will not be required to attend a rehearsal of the event unless otherwise agreed at the time the Contract is made. |
||||
|
*Deems it is the client’s responsibility to ensure that The Photographer is aware of anyone not wishing to be photographed or included in any photographic media presentation. |
||||
| *Deems The Client responsible for ensuring that any DVD media supplied by The Photographer is compatible with the player it will be intended for. | ||||
| “Liability” | ||||
|
The Photographer will take all reasonable care in the execution of the photography. In the event of failure outside the control of The Photographer, The Client shall be limited to a full refund of all monies paid in respect of the booking. |
||||
|
“Size & Colour Matching” |
||||
|
All sizes are nominal; there may be minor variations from those quoted. Totally accurate colour matching to 100% fidelity is rarely possible. The Photographer will endeavour to produce the closest match within the limitations of materials and process. |
||||
|
"Copyright" |
||||
|
The Copyright of all photographs created by The Photographer shall be and shall remain the property of The Photographer in accordance with Copyright, Designs and Patents Act 1988, except where agreed overleaf as part of a photographic package endorsed by the photographer. The Client has no right to produce or authorise reproduction of any of the photographs by any means whatsoever including photocopying, scanning into a computer, copying onto film videotape or any other electronic media. Any infringement of this is unlawful and may be a criminal offence. |

|
“Negatives & Electronic Originals” |
||||
|
All original images on film or on electronic media shall remain the property of The Photographer and The Photographer undertakes to file them and store such images safely and to make them available for future reproduction. Prints will become and remain the property of The Client; however, ownership of the prints does not imply ownership of the copyright in the images on them, nor the right to reproduce them by any means. |

|
“Orders & Re-orders” |
||||
|
All orders & re-orders must be made on The Photographers standard order forms and shall be signed by The Client. All orders & re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted unless orders are given in writing. |
||||
|
"General" |
||||
|
If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby. The contract shall be governed by English law. The Client’s statutory rights are not affected. |
||||
